This Privacy Notice explains how information about you is collected, used, shared, stored and secured by EVRTALE and our affiliates and subsidiaries, if any, collectively referred to as “EVRTALE,” “we,” “our” and “us,” when you use our websites, products, services, applications, AI storybook generation tools, downloadable PDFs, forms, checkout pages, and related features, collectively, the “Services,” or when you otherwise interact with us. This Privacy Notice also explains your choices regarding your information.

EVRTALE is committed to protecting your privacy and complying with applicable laws in collecting and processing personal information.

This Privacy Notice provides information regarding the following:

Our Services may contain links to other websites operated by third parties as well as certain features that allow you to interact with third-party services or platforms. Information collected by such third parties is governed by their own privacy policies, which we encourage you to review.

We are not responsible for the privacy or security practices of third-party websites, platforms, payment processors, analytics providers, AI infrastructure providers, or other services that we do not control. Information you provide on public or semi-public venues, including social media platforms, may be viewable by others without limitation as to its use.

What Information We Collect

We collect information about you when you provide it to us, when you use the Services, and when other sources provide it to us. We collect Contact Information, User Account Information, User Activity Information, Uploaded Content, Generated Content, and AI Interaction Information, as such terms are defined below.

  1. Information You Provide to Us, including through the Services. We collect information about you when you input it into the Services, such as when you complete a web form, upload a conversation, submit story preferences, place an order, contact support, or otherwise communicate with us.

The types of information we collect may include but are not limited to your name, email address, billing contact information, phone number, physical address or geographic location, recipient name, dedication text, story title, tone preferences, relationship type, optional instructions, and any other information you choose to provide, collectively, “Contact Information.”

If we establish an account for you, or if you access secured or paid portions of the Services, we may also collect your username, password, authentication information, order history, subscription status if applicable, product selections, and transaction-related information, collectively, “User Account Information.”

Our payment processors also collect payment information to provide paid access to the Services, as described further under the heading “Payment Processing” below.

If you use our Services to upload, submit, import, or otherwise provide WhatsApp chats, text messages, iMessage exports, Android SMS exports, Instagram direct messages, screenshots, documents, text files, photos, images, names, dates, notes, memories, or other materials, including to generate and return a storybook, PDF, or other output, we collect the data contained in and associated with such materials, collectively, “Uploaded Content.”

Uploaded Content may contain personal information, sensitive information, private conversations, information about other people, names, phone numbers, photographs, emotional content, romantic content, family content, health-related references, location references, or other information depending on what you choose to upload.

If you use the Services through interactive features that allow you to answer questions, provide creative direction, request edits, choose a tone, or otherwise provide iterative inputs to assist in the storybook creation process, we collect the prompts, answers, instructions, preferences, and other inputs you provide, collectively, “AI Interaction Information.”

The storybooks, chapters, titles, dedications, summaries, formatted books, print-ready PDFs, and other materials generated by the Services are referred to in this Privacy Notice as “Generated Content.”

  1. Information We Collect Automatically When You Use the Services. We collect information about you when you use our Services, including when you visit and browse our website, begin an upload, complete an upload, generate a storybook, download a PDF, complete checkout, open an email, or take certain actions within the Services.

For example, we may collect and log information about the features you use, access times, pages viewed, browser type, IP address, internet service provider, device type, operating system, referring page, how you found our Services, approximate location, checkout activity, upload activity, generation activity, download activity, and other actions taken within the Services.

We collect the information about you when you use the Services as described in this section above, collectively, “User Activity Information,” using various technologies, including cookies, as described under the heading “How We Use Cookies and Similar Technologies” below.

  1. Information We Collect From Other Sources. We may obtain information about you from third-party partners that market and promote our Services, generate leads for us, provide analytics, support checkout, prevent fraud, or provide other services to us.

We may also receive information about you from login integration partners if you access the Services through a third-party account, such as Google, Apple, or another authentication provider. The information we collect from these sources is generally Contact Information, User Account Information, or User Activity Information.

How We Use Your Information

We use information about you to provide the Services to you, to communicate with you in connection with your use of the Services and requests for information, to market and promote products, services and other offerings, to maintain, monitor and secure the Services, for legal and compliance purposes, and to develop and improve our products and services, as follows:

  1. To Provide Services to You. We use your information, including Contact Information, User Account Information, User Activity Information, Uploaded Content, AI Interaction Information, and Generated Content, in order to perform our contract with you, such as to provide the Services, process your upload, generate your storybook, format your book, create a print-ready PDF, deliver your finished book, process your order, authenticate you if applicable, configure features of the Services for you, personalize and customize your experience, and operate the Services.

  2. To Communicate with You. We use your Contact Information and User Account Information to communicate with you, including to send order confirmations, delivery emails, download links, service updates, technical notices, security alerts, billing messages, administrative messages, and responses to your questions, requests, or customer support inquiries.

  3. To Inform You of Offerings. We may use your Contact Information and User Activity Information to communicate with you about products, services, offers, promotions, updates, rewards, and events offered by EVRTALE and to provide news and information that we think may be of interest to you.

You can opt out from receiving these types of marketing communications at any time, as discussed under the heading “How You Can Opt Out From Receiving Communications, Change Or Request Deletion Of Your Information” below.

  1. To Maintain, Monitor and Secure the Services. We use certain User Account Information, User Activity Information, Uploaded Content, AI Interaction Information, and Generated Content to monitor and analyze trends, usage and activities in connection with our Services; to monitor, detect, investigate and prevent suspicious, fraudulent, unauthorized, abusive, harmful or illegal activity; and to secure the Services and communicate with you regarding any security incidents.

  2. For Legal and Compliance Purposes. We use Contact Information, User Account Information, User Activity Information, Uploaded Content, AI Interaction Information, and Generated Content as reasonably necessary to comply with applicable law, regulation, legal process or governmental request; enforce our agreements, policies and Terms of Service; exercise or defend legal claims; protect us against legal liability; or otherwise protect or defend our rights, property, users, customers, business, or Services.

  3. To Develop and Improve our Products and Services. We may use certain User Activity Information, AI Interaction Information, Uploaded Content, and Generated Content to improve the Services, product offerings, safety systems, formatting, generation quality, personalization, user experience, promotional activity, and business.

We understand that Uploaded Content may include private conversations. Unless you provide consent or unless otherwise disclosed at the point of collection, EVRTALE does not sell your Uploaded Content or Generated Content to third parties.

How We Use Cookies and Similar Technologies

We use cookies and similar technologies such as pixels, web beacons, local storage, and software development kits to collect User Activity Information, including browsing activities and preferences, to improve and customize your user experience and interactions with us.

We or third parties may use cookies and similar technologies on the Services for the following purposes:

  1. Necessary purposes. These are cookies and similar technologies that are required for the operation of certain Services, including cookies that enable secure checkout, account login, upload functionality, fraud prevention, and delivery of the Services.

  2. Functionality. These cookies and similar technologies remember choices you make and are used to recognize you when you return to the Services. This may enable us to personalize the Services for you, remember preferences, and improve your experience.

  3. Analytics. These cookies and similar technologies collect information about how you use the Services. They allow us to recognize and count visitors, understand how visitors move around the Services, identify bugs, improve conversion flows, and measure product performance.

  4. Targeting or Advertising. These cookies and similar technologies may collect information about browsing activities in order to understand interests for marketing purposes. We or third parties may place or recognize these technologies on your browser for the purpose of serving advertisements regarding our products and services that may be of interest to you.

These technologies may also be used for frequency capping, advertising measurement, campaign performance, email engagement, and related analytics.

Disabling Cookies and Similar Technologies

By using the Services and allowing cookies and similar technologies to be placed by us, you consent to our use of these technologies and the User Activity Information generated from them where consent is required by applicable law.

You can withdraw or modify your consent by changing the settings on your browser or device. However, if you choose to disable cookies or similar technologies, your experience using the Services may be diminished and some features may not work as intended.

Although your browser may allow you to transmit a “Do Not Track” or similar opt-out preference signal, our website may not be designed to respond to all such signals unless required by applicable law.

How We Share Your Information

We may share information about you as discussed below. We do not sell your personal information to third parties.

  1. With Other Users or Recipients You Choose. In connection with your use of certain features of the Services, such as sharing, gifting, collaboration, or delivery features, we may share information about you and your Generated Content with other persons as directed by you through your use of the Services.

For example, if you ask us to send a generated book to another person, we may share the book, recipient name, email address, message, or other relevant information needed to complete your request.

  1. With Service Providers. We work with third parties that provide website hosting, infrastructure, maintenance, backup, storage, security, support, artificial intelligence, machine learning, file processing, PDF generation, email delivery, payment processing, fraud prevention, analytics, advertising, marketing, customer support, consulting, and other technical or business services.

These service providers may require access to information about you, including Uploaded Content, AI Interaction Information, and Generated Content, to perform services on our behalf.

We share your information with these service providers only for business purposes pursuant to contracts or applicable terms. Our service providers are required to retain, use and disclose your information only as necessary to provide services to us or as otherwise permitted by law.

  1. With Your Consent. We share information about you with third parties when you give us consent or direct us to do so. For example, we may share a testimonial, public sample, case study, review, or storybook preview if you have agreed that we may do so.

  2. For Legal and Compliance Purposes. We may share information about you with a third party if we believe that sharing such information is reasonably necessary to comply with applicable law, regulation, legal process or governmental request; enforce our agreements, policies, or Terms of Service; exercise or defend legal claims; protect the security or integrity of our products and services; or protect EVRTALE, our customers, employees, users, or other persons from harm, legal liability, fraud, abuse, or illegal activity.

  3. In connection with, or during negotiations of, any merger, sale of all or a portion of our business or assets, financing, acquisition, bankruptcy, restructuring, or similar business transaction. We may share your personal information with a prospective buyer, seller, new owner, investor, lender, advisor, or other relevant third party as necessary while negotiating or completing such transaction.

How We Store and Secure Your Information

EVRTALE may store your information on servers located in the United States or in other countries where we or our service providers operate. We may transfer your information to, and process your information in, countries other than the country in which you reside as reasonably necessary to provide the Services or for other legitimate business purposes.

If you are a resident of the EEA or UK, in order to perform our contract with you and provide our Services to you, your data may be transferred to and processed in the United States or other countries outside the EEA or UK.

To the extent we transfer, store or otherwise process personal data outside the EEA or UK, we will do so in accordance with applicable data protection laws and, where required, rely on appropriate safeguards.

While we have implemented commercially reasonable security measures and safeguards intended to protect your personal information, no security measures are impenetrable and we cannot guarantee perfect security. Any information you send to us electronically, while using the Services or otherwise interacting with us, may not be secure while in transit.

You are responsible for protecting your account credentials, limiting access to your devices, and signing out of the Services after your sessions where applicable. We recommend that you do not use insecure channels to send us information you consider sensitive or confidential.

How Long We Retain Your Information

We retain your information for as long as is reasonably necessary for the purposes specified in this Privacy Notice. When determining the length of time to retain information, we consider various criteria, including whether we need the information to provide the Services, deliver your storybook, administer your account, process payments, resolve a dispute, enforce our contractual agreements, prevent harm, promote safety, maintain security and integrity, comply with legal obligations, or protect ourselves, including our rights, property, products, and Services.

Uploaded Content and Generated Content may be retained for a limited period as needed to generate, deliver, support, improve, or troubleshoot the Services, unless a longer retention period is required or permitted by law.

Subject to operational, legal, security, and fraud-prevention needs, EVRTALE may delete uploaded chat files and generated PDFs after they are no longer needed to provide the Services. Specific retention periods may vary depending on the product purchased, your settings, support requests, legal requirements, and our technical systems.

If you request deletion of your information, we will process that request as described below, subject to legal, operational, security, backup, and compliance exceptions.

How You Can Opt Out From Receiving Communications, Change Or Request Deletion Of Your Information

You can choose the types of communications you wish to receive from us, change your information, or request that we delete certain information at any time, as follows:

  1. Opt Out From Receiving Communications. If you do not wish to receive communications from EVRTALE that do not relate directly to your use of the Services, such as newsletters, promotions, updates, or marketing communications, you can opt out from receiving such communications at any time. We may provide a link in electronic marketing communications to allow you to unsubscribe.

You may also notify us that you do not wish to receive further marketing communications by contacting us at privacy@evrtale.com.

Please note that, in connection with your use of certain Services, we may still need to send you communications that relate directly to your use of the Services, such as order confirmations, delivery emails, download links, technical notices, updates, service notifications, security alerts, billing messages, administrative messages, and support communications.

  1. Change Your Information. You can request that we change or update your information by contacting us at privacy@evrtale.com. We may need to verify your identity before changing certain information.

  2. Delete Your Information. You can request that we delete your information at any time, subject to certain exceptions. You can request deletion by contacting us by email at privacy@evrtale.com.

We will comply with your request within a reasonable period of time and as required by applicable law; however, in certain circumstances, we may not be able or required to delete all of your information.

For example, we may retain certain information if required to complete a transaction, provide the Services, maintain security, prevent fraud, comply with law, resolve disputes, enforce agreements, maintain business records, or for other compliance or auditing purposes as permitted by law.

In addition, if we have deidentified, anonymized or aggregated data such that it no longer identifies or relates to you, we may retain and use that information for any lawful purpose.

Payment Processing

We utilize third-party service providers that act as payment processors for fees payable for certain Services and content that may be purchased through the Services, each a “Payment Processor.”

In order to purchase Services through the Services, you may be required to provide credit card, debit card, billing, or financial account information directly to the Payment Processor. Such payment card or financial account information is not collected or stored by us.

We may receive limited payment-related information from Payment Processors, such as your billing email, transaction ID, payment status, amount paid, product purchased, and other information necessary to confirm and fulfill your order.

Rights of U.S. Residents

This section applies if you are a resident of California, Colorado, Connecticut, Virginia, Utah, or another U.S. state that has passed a privacy law requiring specific privacy notice disclosures. For purposes of this section, references to “personal information” may also include “sensitive personal information” as defined under applicable law.

Depending on where you live, you may have certain rights regarding your personal information, including:

  1. Notice of Information Collected and Used. We collect, use and disclose, and over the past 12 months may have collected, used and disclosed, the following categories of personal information as described further in this Privacy Notice under the headings “What Information We Collect,” “How We Use Your Information,” and “How We Share Your Information”: identifiers, commercial information, internet or other electronic network activity information, approximate geolocation information, audio, electronic, visual or similar information that you upload to the Services, inferences drawn from information you provide or from your activity, account credentials where applicable, and personal information contained in Uploaded Content or Generated Content.

We do not sell your personal information. We do not sell your Uploaded Content. We do not sell your Generated Content.

  1. Right to Know Requests. You may have a right to request the categories and specific pieces of personal information about you that we have collected, the categories of sources from which such information was collected, the business or commercial purposes for which such information was collected, and the categories of third parties with which such information is disclosed.

  2. Right to Delete Requests. You may have a right to request that we delete personal information we maintain about you.

  3. Right to Correct Requests. You may have a right to request that we correct inaccurate personal information we maintain about you.

  4. Right to Opt Out. Depending on applicable law, you may have a right to opt out of certain processing, including targeted advertising, sales of personal information, or profiling with legal or similarly significant effects. EVRTALE does not sell personal information.

  5. Right to Non-Discrimination. We will not discriminate against you for exercising your privacy rights.

You may submit a request to exercise any of these rights by contacting us by email at privacy@evrtale.com. We may need to verify your request by asking you to provide information reasonably necessary to identify you.

You may also designate an authorized agent to make requests on your behalf where permitted by law. Before accepting such a request from an agent, we may require proof that you authorized the agent to act on your behalf, and we may need you to verify your identity directly with us.

Upon receipt of a verifiable request, we will respond as required by applicable law and subject to applicable restrictions and exemptions. If we deny your request, you may appeal our decision by contacting us at privacy@evrtale.com.

Rights of EEA and UK Residents

If you are a resident of the European Economic Area or the United Kingdom, you have certain rights regarding our processing of your personal data, in addition to those discussed elsewhere in this Privacy Notice:

  1. Access. You have the right to receive a copy of your information that we process.

  2. Portability. You have the right to request that we transfer your data in an easily readable format to another company where required by law.

  3. Restriction of processing to storage only. You have the right to require us to stop processing personal information we hold about you, other than for storage purposes, in certain circumstances.

  4. Objection. You have the right to object to our processing of your personal information in certain circumstances.

  5. Withdrawal of consent. Where we rely on consent to process your personal information, you have the right to withdraw this consent.

  6. Complaints. If you have complaints about how we process your personal data, please contact us and we will respond to your request as soon as possible. You may also have the right to file a complaint with a data protection supervisory authority in the country in which you live or work, or where you believe we have infringed data protection laws.

Please note that a number of these rights only apply in certain circumstances, and all of these rights may be limited by law. For example, fulfilling your request may be limited where it would adversely affect other individuals, our rights, our intellectual property, our legal obligations, or where we are required by law to retain your personal information.

Other Important Privacy Information

EVRTALE Acting as a Data Processor or Service Provider

In connection with certain Services, business customers, partners, or other parties may upload, process, store, or share information through the Services, the contents of which may not be fully known to us but may contain personal information.

In these circumstances, EVRTALE may act as a “data processor,” “service provider,” or similar term under applicable privacy laws. We process such information in accordance with the terms of our written agreements and the instructions provided by the relevant customer or party. This Privacy Notice does not apply where EVRTALE processes information solely as a data processor or service provider on behalf of another party, except as required by law.

Use by Children

Our Services are not intended to be used by individuals under the age of 13, and we do not knowingly collect personal information from children under 13.

If we become aware that a child under 13 has provided us with personal information, we will take steps to delete such information. If you become aware that a child has provided us with personal information, please contact us at privacy@evrtale.com.

Users should not upload private conversations involving minors unless they have the legal right and appropriate consent to do so.

Additional Information About Uploaded Conversations and AI-Generated Storybooks

When you choose to use the Services, you may upload personal conversations or related materials to create a personalized storybook. These materials may contain private, sensitive, emotional, romantic, family, friendship, or other personal information about you or other people.

We use Uploaded Content, AI Interaction Information, and related information to generate storybook outputs, including chapters, dedications, titles, summaries, designs, and print-ready PDFs.

You are responsible for the content you upload to the Services. By uploading content, you represent that you have the right to upload it and that your upload does not violate the privacy, intellectual property, or other legal rights of another person.

Generated Content may be based on Uploaded Content, but it may also include creative, fictionalized, edited, summarized, inferred, or stylized elements produced by artificial intelligence or other software tools. You should review Generated Content before sharing, printing, gifting, or distributing it.

Unless you choose to share your Generated Content, EVRTALE does not make your Generated Content publicly available.

Data Protection Representatives

If required by applicable law, EVRTALE may appoint a representative for data protection matters in the European Union, United Kingdom, or other jurisdictions. If such representative is appointed, we will update this Privacy Notice with the relevant contact information.

Changes to our Privacy Notice

We may change this Privacy Notice from time to time. We will post any Privacy Notice changes on this page, with a revised date at the top of this page.

If the changes are material, we may provide a more prominent notice by adding a notice on the homepage, checkout page, login screen, upload screen, or by sending you an email notification.

We encourage you to review the Privacy Notice whenever you access the Services to stay informed about our data privacy practices and your choices regarding your information.
