Acceptance of These Terms of Service

EVRTALE Inc. (“EVRTALE,” “we,” “us,” or “our”) provides our services and related content through our website located at https://www.evrtale.com/ (the “Site”), and through any related technologies, tools, applications, products, features, functionality, and services offered on or through the Site (collectively, the “Service”).

All access and use of the Service is subject to the terms and conditions contained in these Terms of Service, as amended from time to time. By accessing, browsing, uploading content to, purchasing from, or otherwise using any aspect of the Service, you acknowledge that you have read, understood, and agree to be bound by these Terms of Service.

If you do not accept these Terms of Service, you may not access, browse, upload content to, purchase from, or otherwise use the Service.

We reserve the right, at our sole discretion, to change or modify portions of these Terms of Service at any time. If we do this, we will post the changes on this page and will indicate at the top of this page the date these Terms of Service were last revised.

We may also notify you of material changes through the Service, by email, or through other reasonable means. Your continued use of the Service after any such changes become effective constitutes your acceptance of the updated Terms of Service.

PLEASE READ THESE TERMS OF SERVICE CAREFULLY, AS THEY CONTAIN AN AGREEMENT TO ARBITRATE AND OTHER IMPORTANT INFORMATION REGARDING YOUR LEGAL RIGHTS, REMEDIES, AND OBLIGATIONS.

THE AGREEMENT TO ARBITRATE REQUIRES, WITH LIMITED EXCEPTIONS, THAT YOU SUBMIT CLAIMS YOU HAVE AGAINST US TO BINDING AND FINAL ARBITRATION. YOU WILL ONLY BE PERMITTED TO PURSUE CLAIMS AGAINST EVRTALE ON AN INDIVIDUAL BASIS, NOT AS A PLAINTIFF OR CLASS MEMBER IN ANY CLASS OR REPRESENTATIVE ACTION OR PROCEEDING.

Your Privacy: At EVRTALE, we understand that the content you upload may include deeply personal conversations, memories, jokes, emotional moments, relationship details, names, photos, and other sensitive information. For more information, please see our Privacy Policy, located at https://www.evrtale.com/privacy. By using the Service, you consent to our collection, use, storage, processing, and disclosure of personal data as outlined in our Privacy Policy.

Additional Terms: In addition, when using certain features through the Service, you may be subject to additional terms applicable to such features. All such terms are incorporated by reference into these Terms of Service.

Access and Use of the Service

Service Description: The Service is designed to process input data, information, and content that you provide, including chat exports, text messages, WhatsApp conversations, iMessage conversations, Instagram direct messages, Android SMS exports, notes, names, dedications, preferences, titles, memories, files, images, and other materials or information collectively referred to as “Submissions.”

Based on your Submissions, the Service may generate personalized creative output, including written stories, chapters, dedications, character summaries, titles, formatted storybooks, digital books, print-ready PDFs, previews, covers, and related materials collectively referred to as “Output.” Submissions and Output are referred to together as “Content.”

The Service may use artificial intelligence, machine learning systems, formatting tools, design templates, third-party service providers, and, where appropriate, human review to create, improve, deliver, and support the Service.

It is very important that you only upload Submissions that you have rights to use and provide hereunder. By uploading any Submission, you represent and warrant that:

you have, or have obtained, all rights, licenses, consents, permissions, power, and authority necessary to submit and use such Submission in connection with the Service;
your Submissions and the use thereof by the Service, including to generate Output, will not violate any law, contract, confidentiality obligation, privacy right, publicity right, intellectual property right, or other right of any person; and
no additional licenses, permissions, consents, authorizations, or payments are required from any other person or entity arising out of or related to our use of your Submissions to provide the Service.

Personal Conversations: EVRTALE is designed to turn real conversations into meaningful storybooks. You acknowledge that chats often contain information about other people. You are solely responsible for ensuring that you have permission to upload, process, and use any conversation, message, image, name, or personal detail involving another person.

AI-Generated Storybooks: EVRTALE uses generative technology to transform your Submissions into creative Output. Output may be fictionalized, dramatized, summarized, rearranged, interpreted, or embellished. Output may not perfectly reflect the facts, tone, chronology, or emotional meaning of the original Submissions.

Your Registration Obligations: You may be required to register with EVRTALE or provide information about yourself, such as your name, email address, billing details, and book preferences, in order to access certain features of the Service. You agree to provide and maintain true, accurate, current, and complete information.

You must be at least 13 years old to use the Service. If you are under 18 years old, you may use the Service only with the consent of your parent or legal guardian.

Member Account, Password and Security: You are responsible for maintaining the confidentiality of your password and account details, if any, and are fully responsible for any and all activities that occur under your account. You agree to immediately notify EVRTALE of any unauthorized use of your account or any other breach of security.

Modifications to Service: EVRTALE reserves the right to modify, suspend, or discontinue the Service, or any part thereof, temporarily or permanently, with or without notice. You agree that EVRTALE will not be liable to you or any third party for any modification, suspension, or discontinuance of the Service.

General Practices Regarding Use and Storage: You acknowledge that EVRTALE may establish general practices and limits concerning use of the Service, including maximum file sizes, generation limits, storage limits, retention periods, revision limits, and delivery timelines. EVRTALE reserves the right to change these practices and limits at any time, in its sole discretion.

Conditions of Access and Use

User Conduct: You are solely responsible for any use of the Service and for all Submissions that you make available to EVRTALE. You assume all risk associated with your Submissions and Output, including their accuracy, quality, legality, emotional impact, privacy implications, and appropriateness.

EVRTALE is not responsible for, and disclaims liability in connection with, user Submissions, user-generated Output, or any act of sharing, printing, gifting, publishing, or otherwise using Output.

You agree not to use the Service to:

submit, upload, transmit, or otherwise make available any Submissions, or direct the Service to generate any Output, that infringes, violates, or misappropriates any intellectual property, privacy, publicity, contractual, confidentiality, or other rights of any party;
upload any conversation, message, file, image, or personal information that you do not have the right or permission to use;
violate any applicable local, state, national, or international law;
impersonate any person or entity, or falsely state, imply, or otherwise misrepresent your affiliation with any person or entity;
harass, shame, threaten, expose, blackmail, defame, exploit, or emotionally manipulate another person;
create, distribute, or publish Output intended to embarrass, humiliate, deceive, or harm another person;
upload or process conversations involving minors unless you are the parent, legal guardian, or otherwise have lawful authority and appropriate consent;
upload sexually explicit, exploitative, abusive, hateful, discriminatory, violent, defamatory, obscene, or otherwise objectionable content;
solicit personal information from anyone under the age of 18;
post, disclose, collect, or distribute private information about another person without proper consent;
interfere with or disrupt the Service, servers, networks, systems, or security features connected to the Service;
use the Service or Output to create, develop, train, improve, or operate a competing product or service;
scrape, crawl, data mine, copy, harvest, or extract information from the Service;
reverse engineer, decompile, disassemble, or otherwise attempt to discover the source code, systems, models, prompts, workflows, or underlying technology of the Service;
circumvent usage limits, payment requirements, access controls, geographic restrictions, or security measures;
create multiple accounts to abuse free trials, promotions, credits, or usage limits; or
imply that EVRTALE endorses your Submissions, Output, statements, relationship, business, product, or views.

If you are blocked by EVRTALE from accessing the Service, including by blocking your account, device, or IP address, you agree not to take steps to circumvent such blocking.

Fees: To the extent the Service or any portion thereof is made available for any fee, you may be required to select a payment option and provide payment information. You represent and warrant that such information is true, accurate, and complete, and that you are authorized to use the payment method.

You agree to pay EVRTALE the amount specified at checkout or in the applicable payment plan. You are responsible for all taxes associated with your purchase, other than taxes based on EVRTALE’s net income.

Subscription Renewals and Cancellations: EVRTALE may offer subscriptions, memberships, bundles, credits, or recurring plans. If you purchase a subscription, your subscription may automatically renew at the subscription frequency disclosed at checkout unless you cancel before the renewal date.

To avoid future subscription charges, you must cancel your subscription through your account settings or by contacting billing@evrtale.com before the renewal date. Following cancellation, you may continue to have access to the paid Service through the end of the period for which payment has already been made, unless otherwise stated.

Free Trial: EVRTALE may offer free trials or promotional access to paid features. If a free trial converts into a paid subscription, the conversion terms will be disclosed before you are charged. If you do not cancel before the end of the trial period, you authorize EVRTALE or its payment processor to charge your payment method for continued use of the paid Service.

Payment Processing: EVRTALE may use third-party payment processors, such as Polar (acting as Merchant of Record), to process payments. Payment processing services are provided by the applicable payment processor and may be subject to that processor’s own terms and privacy policies.

Refunds and Cancellations: EVRTALE sells personalized, made-to-order digital products that are generated from content you provide and delivered to you as soon as they are created. Because each book is unique to you and delivered immediately, all sales are final and payments are non-refundable once generation, formatting, personalization, or delivery has begun. Where a statutory right of withdrawal or cancellation would otherwise apply to digital content, by purchasing you request immediate performance and acknowledge that you lose that right once generation begins.

EVRTALE may, in its sole discretion, provide a refund, credit, revision, or replacement if the Service fails to deliver the purchased product, a technical issue prevents generation, a duplicate charge occurs, the wrong file is delivered, or applicable law requires a refund.

Commercial Use: Unless otherwise expressly authorized by EVRTALE in writing, you may use Output only for personal, private, non-commercial purposes, including printing, gifting, saving, and sharing privately with the intended recipient. You may not sell, resell, license, publish, mass distribute, advertise with, or otherwise commercially exploit Output.

Printed Products: EVRTALE may offer printed books, hardcover books, softcover books, shipping, gifting, or third-party fulfillment in the future. Printed products may be subject to additional terms. Print colors, trim, margins, paper, binding, and appearance may vary. Shipping estimates are not guaranteed.

Software

Ownership; Restrictions: The technology and software underlying the Service, including any website, application, workflow, formatting engine, design system, prompt system, file-processing tool, database, and related technology, are the property of EVRTALE, its affiliates, or its licensors.

You agree not to copy, modify, create a derivative work of, reverse engineer, reverse assemble, decompile, sell, assign, sublicense, lease, or otherwise transfer any right in the Software.

Any rights not expressly granted herein are reserved by EVRTALE.

Special Notice for International Use; Export Controls: EVRTALE may be accessed from countries around the world. You are solely responsible for ensuring compliance with the laws of your jurisdiction. You may not use the Service if doing so would violate applicable law, sanctions, export controls, data protection laws, or other legal restrictions.

Intellectual Property Rights

Service Content: You acknowledge and agree that the Service may contain content or features protected by copyright, trademark, patent, trade secret, or other proprietary rights and laws. Except as expressly authorized by EVRTALE, you agree not to modify, copy, frame, scrape, rent, lease, loan, sell, distribute, or create derivative works based on the Service or Service Content, in whole or in part.

Trademarks: The EVRTALE name, logo, marks, trade dress, and related branding are trademarks or service marks of EVRTALE. Nothing in these Terms of Service or the Service should be construed as granting any license or right to use EVRTALE trademarks without our prior written permission.

Third-Party Material: Under no circumstances will EVRTALE be liable in any way for content or materials of any third parties, including users. You acknowledge that EVRTALE does not have an obligation to pre-screen content, but EVRTALE has the right, in its sole discretion, to refuse, remove, edit, disable, or decline to generate any content that violates these Terms or is otherwise objectionable.

Content: As between you and EVRTALE, you retain ownership of your Submissions. Subject to your compliance with these Terms and payment of applicable fees, EVRTALE grants you the right to use your purchased Output for personal, private, non-commercial purposes.

By using the Service or otherwise transmitting Submissions to us, you grant EVRTALE and our affiliates, service providers, contractors, successors, assigns, and designees a worldwide, non-exclusive, royalty-free license to host, store, process, reproduce, analyze, transform, format, display, transmit, and otherwise use your Submissions and Output as necessary to provide, operate, maintain, secure, support, and improve the Service.

This license includes the right to use your Content to generate your storybook, format your PDF, process your order, provide customer support, detect abuse, prevent fraud, comply with law, enforce these Terms, and maintain the safety and functionality of the Service.

We do not claim ownership of your private chats. We do not sell your raw chat files. We will not publicly display your private storybook without your permission, except as required by law or as necessary to protect EVRTALE, our users, or the public.

Use of Submissions for model training, if any, will be governed by our Privacy Policy and any consent options made available through the Service.

Due to the nature of artificial intelligence and machine learning, Output may not be unique. Other users may provide similar inputs and receive the same or similar output. Output generated for other users is not your Output.

Usage Data: You authorize EVRTALE and its service providers to derive statistical, analytical, diagnostic, and usage data relating to your use of the Service. EVRTALE may use Usage Data for any lawful purpose in accordance with our Privacy Policy.

Feedback: Any questions, comments, suggestions, ideas, feedback, reviews, testimonials, or other information about the Service provided by you to EVRTALE are non-confidential. EVRTALE may use and share Feedback for any purpose without acknowledgment, attribution, or compensation to you.

Public Sharing and Testimonials: If you choose to publicly share any Output, excerpt, sample, testimonial, cover, or storybook, or authorize EVRTALE to use it for marketing, you grant EVRTALE permission to display, reproduce, distribute, and promote that shared material in connection with EVRTALE.

You are responsible for ensuring that anything you share publicly does not violate another person’s rights or privacy.

Copyright Complaints: EVRTALE respects the intellectual property of others. If you believe that your work has been copied or used in a way that constitutes copyright infringement, you should notify EVRTALE at legal@evrtale.com.

To be effective, the notification should include:

a physical or electronic signature of a person authorized to act on behalf of the owner of the copyright or intellectual property interest;
identification of the copyrighted work or other intellectual property that you claim has been infringed;
identification of the content that is claimed to be infringing and information reasonably sufficient to permit us to locate the content;
your address, telephone number, and email address;
a statement that you have a good faith belief that the disputed use is not authorized by the rights owner, its agent, or the law; and
a statement that the information in your notice is accurate and, under penalty of perjury, that you are the rights owner or authorized to act on behalf of the rights owner.

Repeat Infringer Policy: EVRTALE may, in appropriate circumstances and at its sole discretion, terminate accounts of users who are deemed to be repeat infringers.

Third-Party Services and Websites

The Service may display, include, make available, or provide links or access to services, sites, software, applications, content, data, technology, and resources provided by third parties.

Third-party services may include hosting providers, AI model providers, analytics providers, storage providers, payment processors, email providers, customer support tools, print vendors, shipping carriers, messaging platforms, and file-processing services.

Your access to and use of third-party services may be subject to additional terms, privacy policies, or agreements with those third parties.

EVRTALE has no control over and is not responsible for third-party services, including their accuracy, availability, reliability, privacy practices, data practices, security, pricing, outages, delays, or content.

EVRTALE is not affiliated with, endorsed by, or sponsored by WhatsApp, Meta, Instagram, Apple, iMessage, Google, Android, or any messaging platform unless expressly stated.

Indemnification

To the extent permitted under applicable law, you agree to defend, indemnify, and hold harmless EVRTALE, its affiliates, and its and their respective officers, employees, directors, contractors, service providers, licensors, and agents from and against any losses, damages, expenses, claims, actions, liabilities, and costs, including reasonable attorneys’ fees, arising out of or relating to:

your use of the Service;
your Submissions;
your Output;
your sharing, printing, gifting, publication, or commercial use of any Output;
your violation of these Terms of Service;
your violation of any law or regulation;
your violation of any rights of another person; or
your failure to obtain consent from people whose conversations, names, images, likenesses, personal information, or other content appear in your Submissions.

EVRTALE reserves the right to assume the exclusive defense and control of any matter subject to indemnification, and you agree to cooperate with any reasonable requests assisting EVRTALE’s defense of such matter.

Disclaimer of Warranties

YOUR USE OF THE SERVICE AND ANY OUTPUT IS AT YOUR SOLE RISK. THE SERVICE AND ANY OUTPUT ARE PROVIDED ON AN “AS IS” AND “AS AVAILABLE” BASIS.

EVRTALE EXPRESSLY DISCLAIMS ALL WARRANTIES OF ANY KIND, WHETHER EXPRESS, IMPLIED, STATUTORY, OR OTHERWISE, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, NON-INFRINGEMENT, ACCURACY, RELIABILITY, AND AVAILABILITY.

EVRTALE MAKES NO WARRANTY THAT:

THE SERVICE WILL MEET YOUR REQUIREMENTS OR EXPECTATIONS;
THE SERVICE WILL BE UNINTERRUPTED, TIMELY, SECURE, OR ERROR-FREE;
THE OUTPUT WILL BE ACCURATE, COMPLETE, UNIQUE, ERROR-FREE, EMOTIONALLY APPROPRIATE, OR SUITABLE FOR ANY PARTICULAR PURPOSE;
THE OUTPUT WILL NOT INFRINGE THE RIGHTS OF ANY THIRD PARTY;
ANY FILES, CHATS, SUBMISSIONS, OR OUTPUT WILL BE STORED INDEFINITELY; OR
THE RECIPIENT OF A STORYBOOK WILL LIKE, ACCEPT, OR RESPOND POSITIVELY TO THE OUTPUT.

YOU ACKNOWLEDGE THAT THE SERVICE USES ARTIFICIAL INTELLIGENCE AND EXPERIMENTAL TECHNOLOGY AND MAY SOMETIMES PROVIDE INACCURATE, UNEXPECTED, OFFENSIVE, OR OTHERWISE UNSATISFACTORY CONTENT.

EVRTALE IS A CREATIVE TECHNOLOGY SERVICE. IT DOES NOT PROVIDE LEGAL, MEDICAL, MENTAL HEALTH, FINANCIAL, RELATIONSHIP, OR PROFESSIONAL ADVICE.

Limitation of Liability

YOU EXPRESSLY UNDERSTAND AND AGREE THAT EVRTALE AND ITS AFFILIATES, OFFICERS, DIRECTORS, EMPLOYEES, CONTRACTORS, SERVICE PROVIDERS, LICENSORS, AND AGENTS WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES.

THIS INCLUDES DAMAGES FOR LOSS OF PROFITS, LOSS OF GOODWILL, LOSS OF USE, LOSS OF DATA, EMOTIONAL DISTRESS, RELATIONSHIP HARM, BUSINESS INTERRUPTION, OR OTHER INTANGIBLE LOSSES, WHETHER BASED ON CONTRACT, TORT, NEGLIGENCE, STRICT LIABILITY, OR OTHERWISE.

IN NO EVENT WILL EVRTALE’S TOTAL LIABILITY TO YOU FOR ALL DAMAGES, LOSSES, OR CAUSES OF ACTION EXCEED THE GREATER OF:

THE AMOUNT YOU PAID EVRTALE IN THE SIX MONTHS BEFORE THE CLAIM AROSE; OR
ONE HUNDRED U.S. DOLLARS ($100).

SOME JURISDICTIONS DO NOT ALLOW CERTAIN DISCLAIMERS OR LIMITATIONS OF LIABILITY. ACCORDINGLY, SOME OF THE ABOVE LIMITATIONS MAY NOT APPLY TO YOU.

Dispute Resolution By Binding Arbitration

PLEASE READ THIS SECTION CAREFULLY AS IT AFFECTS YOUR RIGHTS.

Agreement to Arbitrate: This Dispute Resolution by Binding Arbitration section is referred to in these Terms of Service as the “Arbitration Agreement.”

You agree that any and all disputes or claims that have arisen or may arise between you and EVRTALE, whether arising out of or relating to these Terms of Service, the Service, any Content, any purchase, any advertising, or any aspect of the relationship or transactions between us, will be resolved exclusively through final and binding arbitration, rather than in court, except that you may assert individual claims in small claims court if your claims qualify.

You agree that, by entering into these Terms of Service, you and EVRTALE are each waiving the right to a trial by jury or to participate in a class action.

The Federal Arbitration Act governs the interpretation and enforcement of this Arbitration Agreement.

Prohibition of Class and Representative Actions and Non-Individualized Relief: YOU AND EVRTALE AGREE THAT EACH OF US MAY BRING CLAIMS AGAINST THE OTHER ONLY ON AN INDIVIDUAL BASIS.

NEITHER YOU NOR EVRTALE MAY BRING A CLAIM AS A PLAINTIFF OR CLASS MEMBER IN ANY CLASS ACTION, REPRESENTATIVE ACTION, COLLECTIVE ACTION, PRIVATE ATTORNEY GENERAL ACTION, OR CONSOLIDATED PROCEEDING.

Unless both you and EVRTALE agree otherwise, the arbitrator may not consolidate or join more than one person’s claims and may not preside over any form of class, representative, collective, or consolidated proceeding.

Pre-Arbitration Dispute Resolution: EVRTALE is interested in resolving disputes amicably and efficiently. Most customer concerns can be resolved by contacting support@evrtale.com.

If such efforts are unsuccessful, a party who intends to seek arbitration must first send the other party a written Notice of Dispute. The Notice to EVRTALE should be sent to legal@evrtale.com and to the mailing address listed below.

The Notice must describe the nature and basis of the claim or dispute and set forth the specific relief sought. If EVRTALE and you do not resolve the claim within sixty calendar days after the Notice is received, either party may commence arbitration.

Arbitration Procedures: Arbitration will be conducted by a neutral arbitrator in accordance with the American Arbitration Association’s Consumer Arbitration Rules, as modified by this Arbitration Agreement.

Unless EVRTALE and you agree otherwise, any arbitration hearings will take place in Los Angeles County, California, or remotely if permitted by the arbitrator or agreed by the parties.

The arbitrator will issue a reasoned written decision sufficient to explain the essential findings and conclusions on which the award is based.

Costs of Arbitration: Payment of filing, administration, and arbitrator fees will be governed by the applicable arbitration rules, unless otherwise required by law.

Confidentiality: All aspects of the arbitration proceeding, and any ruling, decision, or award by the arbitrator, will be confidential to the extent permitted by law.

Severability: If any part of this Arbitration Agreement is found invalid or unenforceable, the remaining parts will remain in effect, except where the class action waiver is found unenforceable in a way that requires the entire Arbitration Agreement to be invalidated.

Future Changes to Arbitration Agreement: If EVRTALE makes a future change to this Arbitration Agreement, you may reject that change by sending written notice to legal@evrtale.com within thirty calendar days of the change.

Termination

You agree that EVRTALE, in its sole discretion, may suspend or terminate your account, access to the Service, or use of the Service, and may remove or discard any Content within the Service, for any reason, including lack of use or if EVRTALE believes that you have violated these Terms of Service.

Any suspected fraudulent, abusive, or illegal activity may be referred to appropriate law enforcement authorities.

EVRTALE may also discontinue or suspend providing the Service, or any part of the Service, at any time, with or without notice.

Termination does not affect any rights or obligations that by their nature should survive, including payment obligations, ownership provisions, disclaimers, limitations of liability, indemnification, arbitration, and general legal provisions.

SMS Messaging

Certain portions of the Service may allow EVRTALE to contact you via telephone or text message. You agree that we may contact you at phone numbers provided by you in connection with your use of the Service, including for transactional, account, support, delivery, security, billing, and marketing purposes where permitted by law.

You understand that you are not required to provide consent to marketing text messages as a condition of purchasing any paid Service.

You may opt out of receiving marketing text messages from us at any time by replying STOP or by contacting support@evrtale.com.

User Disputes

You agree that you are solely responsible for your interactions with any other person in connection with the Service, including any person whose messages, name, likeness, image, personal information, or relationship details appear in your Submissions or Output.

EVRTALE will have no liability or responsibility with respect to such interactions.

EVRTALE reserves the right, but has no obligation, to become involved in disputes between users or between users and third parties.

General

These Terms of Service, together with the Privacy Policy and any terms incorporated by reference, constitute the entire agreement between you and EVRTALE governing your access to and use of the Service.

These Terms supersede any prior agreements between you and EVRTALE with respect to the Service.

These Terms of Service will be governed by the laws of the State of California, without regard to its conflict of law provisions.

With respect to any disputes or claims not subject to arbitration, you and EVRTALE submit to the personal and exclusive jurisdiction of the state and federal courts located in Los Angeles County, California.

The failure of EVRTALE to exercise or enforce any right or provision of these Terms of Service will not constitute a waiver of such right or provision.

If any provision of these Terms of Service is found by a court or arbitrator to be invalid, the parties agree that the court or arbitrator should endeavor to give effect to the parties’ intentions as reflected in the provision, and the other provisions of these Terms of Service will remain in full force and effect.

The section titles in these Terms of Service are for convenience only and have no legal or contractual effect.

As used in these Terms of Service, the words “include” and “including” will be deemed to be followed by the words “without limitation.”

EVRTALE will not be in default by reason of any failure or delay in performance due to circumstances beyond its reasonable control, including civil disturbances, riot, epidemic, pandemic, hostilities, war, terrorist attack, embargo, natural disaster, acts of God, flood, fire, sabotage, power outages, internet outages, network failures, service provider failures, payment processor failures, supply chain issues, shipping delays, or other circumstances beyond EVRTALE’s reasonable control.
